Terms of Service

These terms govern your use of Band OS. By using your account or the app you agree to them. Please read section 3 in particular: Band OS is free today, but we may introduce charges in the future.

Our legal notice and Privacy Policy are part of how we describe the service to you.

Current status. Band OS is currently run by a team that is not yet an incorporated or registered business. This is planned and will happen soon. Using Band OS is entirely optional, and if you do use it you do so on your own responsibility and under our Terms. This does not limit any rights you have under mandatory law, such as data protection and consumer protection law. When the business is incorporated and registered, we will update the provider details above, our legal notice and these terms, and tell registered users.

2. The service

Band OS is a web app for bands and music groups: songs and lyrics, setlists, an audio library, rehearsal and show scheduling with invitations and RSVPs, announcements, and an optional public band page. It is provided over the internet. We may improve or change features over time, and we aim to keep it available at all times, but we cannot promise that.

3. Free to use, and possible charges in the future

  • Band OS is free to use at the moment. We do not charge anything today and we do not collect any payment details.
  • We may introduce pricing in the future. We have not decided on any plans or prices. If we introduce paid features or plans, they will be published before they apply.
  • Notice before any charge. We will tell you at least 30 days before anything is charged, by email to the address on your account and on our website.
  • You will never be charged automatically. You are only charged if you actively choose to pay and provide payment details. If you do nothing, you will not be billed.
  • Your data stays yours. If you decide not to pay for something we introduce, you can ask us to export your data (email musik.espresso@gmail.com) and we will keep it available for at least 30 days after any charges start. Features or storage limits may be reduced for accounts that do not pay, and we will say so in the notice.
  • When you buy something, further terms (including your statutory right of withdrawal as a consumer and how to cancel) will be shown to you before you pay.

4. Your account

  • You must be at least 16 years old to have an account.
  • Accounts are currently created by us on request (self-service sign-up is closed). By using your account you agree to these terms.
  • Give accurate information, keep your sign-in secure, and tell us if you think someone else has access. You are responsible for activity under your account.
  • If you create a band or accept an invitation as an owner or admin, you confirm you are authorised to manage that band’s space and the people in it.
  • One person, one account. Do not share logins.

5. Your content

  • You own your content (songs, lyrics, audio, images, notes, etc.). You grant us a limited, non-exclusive licence to store, process and display it solely to run Band OS for you and the people you share it with, including showing what you publish on a public band page.
  • You are responsible for what you upload. Only upload material you have the right to use. That includes music and lyrics: do not upload or share recordings, stems or lyrics you do not own or have permission to use.
  • Other people’s data. If you enter other people’s personal data (for example bandmates’ emails or fans’ details), you must be entitled to, and you must handle it lawfully.
  • Sensitive information. Do not put health data or other special-category information in notes, vacation reasons or other free-text fields.

6. Acceptable use

You agree not to:

  • break the law or infringe anyone’s rights (including copyright and privacy);
  • upload malware, or attempt to disrupt, scrape, probe or gain unauthorised access to the service or other users’ data;
  • send spam or use invitations, fan-page sign-ups or notifications to contact people who have not asked to hear from you;
  • upload unlawful, hateful, harassing or sexually explicit content, or content that exploits minors;
  • use the service in a way that places an unreasonable load on it, or resell it without our written permission.

7. Public band pages and reporting content

Anything a band publishes on its public page is visible to anyone on the internet. If you believe content on Band OS is unlawful or infringes your rights, email musik.espresso@gmail.com with the address of the content, what is wrong, and your contact details. We will review it and act, which may include removing it or suspending the account responsible. This address is also our single point of contact for authorities and users (EU Digital Services Act, Art. 11 and 12).

8. Availability, changes and liability

  • Band OS is provided “as is” while it is free. We may change, limit or discontinue features. If we ever decide to shut the service down, we will give you reasonable notice and a chance to export your data.
  • Please keep your own backups of anything important, especially recordings and lyrics.
  • Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, in particular liability for intent or gross negligence, for injury to life, body or health, and under mandatory consumer-protection and product-liability rules. Subject to that, we are not liable for indirect or consequential loss, or for loss of data or content that you could have backed up.

9. Ending your use

You can stop using Band OS at any time and ask us to delete your account (email musik.espresso@gmail.com). We may suspend or end your access if you seriously or repeatedly breach these terms, or if we are legally required to, normally after a warning, and with the chance to export your data unless the breach makes that inappropriate.

10. Changes to these terms

We may update these terms, for example if we introduce pricing. We will notify registered users by email at least 30 days before a change that materially affects them takes effect. Continuing to use Band OS after that date means you accept the change; if you do not agree, you can stop using the service and export your data.

11. Consumer rights

If you are a consumer, you keep the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country. Nothing in these terms limits those rights.
